There can be pretty intense legal battles for people who are now estranged from their former spouse, family member or roommate and there are times that an order of protection is needed if someone has claimed to be the victim of domestic violence. Order of Protection Process
If someone files an order of protection against you, they need to go to the Circuit Court to file a Petition for Order of Protection. This will include why the person is looking to file an order of protection against you. This will usually include information about the history of your relationship with that person, along with any alleged acts of abuse. Another more commonly used term for an order of protection is a restraining order.  

The petition will then go to a civil domestic violence judge to be reviewed. There are three possible decisions the judge can make. The first is to deny the motion. The second is to grant the motion on a temporary basis right away due to perceived emergency. The third outcome is to schedule a hearing and decide on the motion after hearing arguments from both parties involved.
